What is GST?

Goods and Service Tax or GST is the biggest Indirect Tax passed on 29th March 2017 in the Parliament under the Goods and Service Tax Act. This one tax replaced almost all other indirect tax laws that previously existed in India. GST came into effect on 1st July 2017. Now it is one tax for the entire country.

The journey of GST started in the year 2000, when a specially formed committee drafted the law. And it took 17 years for the law to mould and evolve. The GST Bill was passed in 2017 in Lok Sabha and Rajya Sabha and by 1st July 2017, the GST law was implemented.

Under the GST regime, the tax is levied at every point of sale. In the case of intra-state sales, Central GST and State GST are charged. Inter-state sales are chargeable to Integrated GST.

  • There are 3 different taxes applied under this system: CGST, SGST & IGST.
  • CGST is for intra-state sale and are collected by the Central Government on an intra-state sale.
  • SGST is collected by the State Government for intra-state sale and finally,
  • IGST which is collected by the Central Government on inter-state sales.

Why GST is needed ?

One of the important reasons to introduce GST in India is to integrate almost all taxes into a single one. Earlier the VAT rates and regulations are different from state to state. And it has been noticed that states often fall back to slashing these rates to attract investors. These slashing results in revenue loss for both the State and Central government.

Refer Section 2(6) of CGST Act. Aggregate turnover does not include value of inward supplies on which tax is payable on reverse charge basis.
Yes, Companies Act 2013 provides rules for converting a private limited company into a public limited company.
If the person is involved in 100% supply of goods which are not liable for GST, then no registration is required.
Not liable to tax means supplies which is not leviable to tax under the CGST/SGST/IGST Act. Please refer to definition under Section 2(78) of the CGST Act.
SEZs under same PAN in a state require one registration. Please see proviso to rule 8(1) of CGST Rules.
GST is leviable only if aggregate turnover is more than 20 lacs. (Rs. 10 lacs in 11 special category States). For computing aggregate supplies turnover of all supplies made by you would be added.
A person dealing with 100% exempted supply is not liable to register irrespective of turnover.
There will be only one registration per State for all activities.
There will be no area based exemptions in GST.
Every private limited company must hold a board meeting atleast once in every three months and an Annual general meeting (AGM) every year.
If services are being provided from Nasik then registration is required to be taken only in Maharashtra and IGST to be paid on inter-state supplies.
